Comic Relief’s Joke-A-Thon Program (“Program”) Submission Terms

HOW TO SUBMIT: Create a video of your child(ren) telling their jokes (“Video”), then post the Video on Instagram, Twitter, or TikTokwith #PickMeForRedNoseDay. Your Instagram, Twitter or TikTok account (as applicable) must be set to “public”. You can return the applicable account to “private” at any time after the Program has ended. If you do not have an Instagram, Twitter or TikTok account, creating an account is free. All applicable platform terms apply. Videos must be submitted by no later than 11:59 PM Pacific Time (PT) on May 3, 2020.

REQUIREMENTS OF VIDEOS: Joke(s) should be appropriate for a general audience and Video must have been filmed by you. Video must not have been previously published and should not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity (e.g., clothing or posters with recognizable cartoon characters, action figures, superheroes, celebrities, or logos or names of third parties). Video should not make a representation that the joke(s) is/are original to the child(ren) if it/they are not.

SELECTED VIDEOS: If your Video is selected, you will be notified by direct message, @reply or comment on the Video. You may be required to execute and return a Liability and Publicity Release. If you do not respond to the initial notification within the time period stated, do not return all required documentation within the time period stated, or if a notification is returned as undeliverable, or you are not in compliance with these Submission Terms, your Video will not be used.

PUBLICITY GRANT AND LICENSE/USE OF VIDEOS: By submitting a Video, you, on behalf of yourself and your child(ren), waive all moral rights in and to the Video and grant to Comic Relief and its licensees, successors and assigns (including, but not limited to, The Kelly Clarkson Show) an irrevocable, perpetual, unlimited, royalty-free, fully paid-up license to reproduce, distribute, display, exhibit, exploit, perform, edit, create derivatives of, and otherwise use the Video and all elements of such Video, together with any other material, and your name, user name, city and state of residence, voice, image and/or likeness (including, but not limited to, your profile photo), and the first name, voice, performance and image of your child(ren) who appear in the Video, in any and all media now known or hereafter devised (including, but not limited to, on The Kelly Clarkson Show as well as on Comic Relief’s and The Kelly Clarkson Show’s websites and/or social media channels), in any manner, in whole or in part, worldwide, without compensation or notification to, or permission from you or any third party, for any purpose whatsoever, including without limitation, for purposes of advertising or trade. You agree that, if required by Comic Relief, you will sign documents to this effect for yourself and your child(ren). Released Parties are not responsible for any unauthorized use of Videos by third parties. Comic Relief has no obligation to make use of the rights granted herein.

GENERAL CONDITIONS: By participating, you, on behalf of yourself and your child(ren), agree to release, discharge and hold harmless Comic Relief, Inc., Facebook Inc. (Instagram), Twitter, Inc., ByteDance Ltd. (TikTok), and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from your participation in the Program or any Released Party’s use of any rights granted herein. Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered or garbled Videos, posts, direct messages, comments, @replies or other communications; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Program, including, without limitation, errors or difficulties which may occur in connection with the administration of the Program or in any Program-related materials.

Released Parties are not responsible for injury or damage to any person's computer or mobile device related to or resulting from participating in this Program or downloading materials from or use of the website or platform. Comic Relief reserves the right at its sole discretion to suspend, modify or terminate the Program at any time. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROGRAM MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, COMIC RELIEF RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
